City of London Law Society Short Form Report on Title. The Short Form Report on Title, which has been revised in 2018 (12/03/2018) following its third edition in 2007, reflects changes in the law and practitioners’ approaches to reporting on title, as well as changes to the CLLS Certificate of Title in the intervening period. For clarity, the notes to the Report highlight the circumstances when it would be used instead of the Certificate of Title. This replaces the City of London Law Society 3rd Edition Short Form Report on Title dated 4th July 2013, which should no longer to be used as a precedent. Note that a change has been made to Schedule 2 for the Economic Crime (Transparency and Enforcement) Act 2022 (further information on this is contained in the Note to Users).

The consultation sought views on the Government’s proposals to create a new service delivery company to take over responsibility for processing land and property registration from HM Land Registry. The submission responded in detail to the consultation, and raised a number of general concerns, including that “in view of the fundamental nature of the [consultation] proposals, we consider that inadequate information has been provided in the consultation. Many statements have been made, but insufficient evidence has been provided to support the statements.”

Practitioners should bear in mind the High Court decision in Good Harvest Partnership LLP v Centaur Services Limited [23 February 2010] in relation to the following sections of the certificate of title- paragraph 8.4 of Schedule 4 and the box in Part 8A of Schedule 5 which states "Name of every unreleased former tenant who has entered into an authorised guarantee agreement and of every unreleased former guarantor who has entered into a guarantee of that authorised guarantee agreement." However, the Land Law Committee has decided not to suggest a standard qualification to take account of the Good Harvest decision. The provider of the certificate should qualify those sections (as with any other qualification to the certificate) when considered appropriate in the context of the particular transaction, property and documentation.
