29/08/2023 - Law Society submission - Sanctions paper and Draft general licence - 07 07 23
The City solicitors' profession gave a detailed response to HM Government’s proposed amendments to UK sanctions regulations. The new regulations were designed to prevent UK lawyers from advising Russian companies, thereby preventing Russia from benefitting economically from UK lawyers’ global expertise. City solicitors, The Law Society, and members of City of London Law Society (CLLS) firms all expressed concern that the proposed regulations would impact severely on the advice which could be given to UK businesses who were seeking to comply with United Nations sanctions. They also expressed concern that the proposals would counterintuitively make it more difficult for UK lawyers and in-house counsel to give robust and independent advice to their clients and employers. A group of lawyers from the City, coordinated by the Law Society, set to work preparing papers setting out the concerns of the profession to the Ministry of Justice UK, and drafted amendments to its proposed guidance and draft licence. Commenting on the working group’s initiative, the CLLS said that “it was an impressive commitment from the profession, made over the course of just a couple of weeks, to assist HM Government in their work. It also highlights the resources available to the Government and UK business from our world leading lawyers based here in the City of London".
