The consultation put forward a range of proposals, which DCLG stated would “further improve the planning system and build upon the improvements we have already made”. The Committee submitted a detailed response to the consultation questions.
15/09/2014 - Response to the English Heritage consultation on Historic Environment Good Practice Advice in Planning
The consultation invited views on several “Historic Environment Good Practice Advice Notes”, namely notes on “The Historic Environment in Local Plans”, “Decision-Taking in the Historic Environment” and “The Setting of Heritage Assets”. The purpose of the notes was described as being to assist local planning authorities, planning and other consultants, owners, applicants and other interested parties in implementing historic environment policy in the National Planning Policy Framework and the related guidance given in the Planning Practice Guidance, recently published by the Government. In its submission, the Committee stated that it viewed the amalgamation of English Heritage’s advice into one source as a positive step. The Committee also noted that, as much of the advice had been previously published, it had no particular concerns in respect of the contents, and that the submission responded only to the questions raised. The submission went on to respond in detail to the consultation questions.
20/08/2014 - Response to DECC’s Consultation on Proposal for Underground Access for the Extraction of Gas, Oil or Geothermal Energy
The consultation sought views on proposals to reform the procedure for gaining underground access to oil or gas deposits and geothermal energy. The submission, which was made mainly in relation to oil and gas drilling, responded to the questions in the consultation paper. It also noted generally that, in light of the Government’s policy decision to promote such exploration, the Members of the Committee were in favour of the proposed solution set out in the consultation paper. In conclusion, the Committee urged the Government to adopt the clear proposals in the Consultation Paper in order to remove one of the inappropriate hurdles, which currently presents delays and ambiguity in the consent process for on-shore exploration and extraction of both conventional and unconventional hydrocarbons.
16/01/2014 - Written evidence provided to the Environmental Audit Select Committee regarding its Inquiry into Invasive Species
The inquiry concerns the prevention and management of the introduction and spread of invasive alien species, particularly Japanese Knotweed. It called for the introduction of clear guidance on the legislation surrounding Japanese Knotweed, as well as for a change in existing legislation to plug the gap between lenders and borrowers.
21/11/2013 - Response to Defra green paper on biodiversity off-setting in England
The consultation document, “Biodiversity Offsetting in England”, set out options for the Government’s proposed biodiversity offsetting system and posed questions about how the system may best operate. The Committee’s submission in response set out answers to the specific consultation questions, including noting that the Committee considers that there is merit in the introduction of a biodiversity off-setting system to work alongside the planning system, and that it broadly agrees with the Government’s objectives for the system and the proposed characteristics of the system.
05/11/2013 - Response to the Ministry of Justice consultation paper Judicial Review: Proposals for further reform
The consultation invited views on potential measures for the further reform of judicial review, and followed on from the Government’s earlier judicial review consultation, which closed in January 2013. The Committee’s response was concerned solely with those questions in the Consultation Paper that immediately concern the planning & environmental law practitioners who make up the membership of the Committee. In general, the Committee described the Ministry of Justice’s further set of proposals for the reform of Judicial Review as premature, considering that the results of the earlier reforms introduced in July 2013 through the Civil Procedure (Amendment No 4) Rules 2013 (SI 2012/1412), and similarly the planning fast-track procedure introduced by the Administrative Court, have yet to be properly assessed.
